Warranty

The Company warrants that products manufactured or sold by it shall be free from defects in material and workmanship. Any product which shall, within one year from delivery be proven to the Company’s satisfaction to have been defective at the time of delivery in these respects shall be replaced or repaired by the Company at its option. The Company’s liability under this warranty is limited to such replacement or repair and it shall not be held liable in any form of action for direct or consequential damages to property or person. THE FOREGOING WARRANTY IS EXPRESSLY MADE IN LIEW OF ALL OTHER WARRANTIES WHATSOEVER, EXPRESSED, IMPLIED AND STATUTORY AND INCLUDING WITHOUT LIMITATION. THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS. As there is no wide a variety of conditions under which the Company’s products may operate, any greater responsibility the herein set forth can not be assumed by the Company unless a specific warranty is requested by the customer and agreed to by the Company in writing.

Consequental Damages

The Company shall not be liable to the customer and other claiming through the customer for special consequential damages for any reason whatsoever.
